Privacy policy

1. Who?

This privacy policy governs the processing of personal data by the data controller BELPARTS NV, having its registered office at WINGEPARK 4, 3110 ROTSELAAR, BELGIUM with company registration number 0432.922.579.

2. Which data?

The general data protection regulation defines the term personal data as follows:
All information relating to an identified or identifiable natural person (“the data subject”). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person

In particular, the following data can be collected:

  • Information of registered users (not possible to disable);
  • App settings chosen on ‘settings screen’ (not possible to disable);
  • History of connected devices (can be cleared and user can also opt out);
  • Device placement information (optional feature).

The above list is in no way whatsoever exhaustive. We do not process any special or sensitive personal data.
All of above information is cleared on uninstalling the application.

3. What do we do with your information?

When you open the mobile device application from BELPARTS APP, we collect the personal information you give us. This processing is necessary for the performance of the agreement with our customer and to provide and improve our service. By using our application, you agree to the collection and use of information in accordance with our policy. When you browse our application, we also automatically receive your mobile device internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

We reserve the right to save your personal information. While using our application, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. You have the right to enquire and/or correct the personal information you provided us.

Your information can be used to inform you about relevant products and services. We want to maintain its customer relationship. With your permission, we may therefore use your contact data to keep you informed about our company, new products and other updates. Sending such messages to promote our offers and services and to tailor them to your possible needs better to our customers is in our legitimate interest and is also in the interest of our customers. Customers can always unsubscribe from such messages.

4. Privacy law

We use your personal information only in accordance with the Regulation of the European Parliament and the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC or General Data Protection Regulation or the General Data Protection Regulation (“GDPR”). This also gives you the legal right to access, correct, modify or delete your personal data, on condition that these are correct and do not lead to identity fraud. Your details will not be disclosed to third parties for information or publicity purposes.

5. Consent

How do you get my consent?
When you provide us with personal information, we imply that you consent to us collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like commercial purposes, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

How do I withdraw my consent?
If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at any time. Please contact us in any way as described below.

6. Disclosure

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

7. Third-party services

In general, the third-party providers will only collect, use and disclose your personal information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways, other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So, if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

BELPARTS APP will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy. No transfer of your personal data will take place to an organization or a country unless there are adequate controls in place, including the security of your data and other personal information.

If you agree, BELPARTS APP will share your data with our partner companies so that they may offer you their products and services. BELPARTS APP does not give your information to third parties without your explicit permission in advance.

When BELPARTS APP processes your order, it may send your data to, and also use the resulting information from credit reference agencies to prevent fraudulent purchases.

Once you leave our application or when you are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our application’s Terms & Conditions.

8. Duration of the processing

We keep the personal data of the various parties for at least 10 years following the end of the commissions it was entrusted, as legal claims based on the performance of the agreement may be instituted for 10 years after termination. Data used solely in the context of direct marketing or sending newsletters is kept 5 years.

9. Security

To protect your personal information, we take reasonable precautions and follow the industry’s best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with an AES-256 encryption. Although, no method of transmission over the Internet or electronic storage is 100% secure, we follow and implement additional generally accepted industry standards.

10. Rights of data subjects

You have the right of access to your personal data free of charge and at any time, as well as to the purposes for which we process your personal data.

The right to rectification, erasure and restriction
You are free to notify your personal data to us, or not. In addition, you always have the right to obtain from us that we rectify, supplement or erase your personal data. You acknowledge that if you refuse to provide personal data or you request the erasure of personal data, certain services cannot be provided.
You also have the right to obtain a restriction of the processing of your personal data.

The right to object
You also have the right to object against the processing of your personal data for serious and legitimate reasons.
In addition, you always have the right to object to the use of personal data for direct marketing purposes. In such case you do not have to specify reasons.

The right to data portability
You have the right to receive the personal data that you provided to us in a structured, commonly used and machine-readable format and/or to transmit those data to other controllers.

The right of withdrawal of consent
In so far, the processing is based on your prior consent, you have the right to withdraw the consent.

The right to exercise of your rights
You can exercise your rights by contacting us, either by e-mail to info@belparts.com or by post to WINGEPARK 4, 3110 ROTSELAAR subject to enclosing a copy of your identity card.

The right to automatic decisions and profiling
The processing of your personal data does not comprise profiling, nor shall we subject it to automated decisions.

The right to lodge a complaint
You have the right to lodge a complaint with the Belgian Privacy commission:

11. Age of consent

By using this application, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

12. Changes of this privacy policy

We reserve the right to modify this Privacy Policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the application. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.
